This policy describes how AXONMED Co., Ltd. ("AXONMED", "we") collects, uses and shares consumer health data of Nevada consumers in the Bodycheck Care app (the global version, which is for people aged 18 and over) and its watch apps, as required by Nevada law (Senate Bill 370 of 2023).
1. Categories of consumer health data we collect, and why
- Body scan photos and results (the photos and copies with the landmarks drawn on them, body landmark positions including five points on the face for the nose, eyes and ears, alignment angles, centre-of-gravity values, scores, grade, findings, body outline): to analyse your posture, show your results and compare scans.
- Body measurements and body-composition estimates (height, weight, waist circumference, estimated body-fat percentage, lean mass and circumferences): to estimate your body composition and show trends.
- Health values you enter (blood pressure, blood glucose, HbA1c, weight, body-composition test results): to keep your log; and, for body-composition results you log, to adjust (calibrate) your later photo-based body-composition estimates. This adjustment is done on our server using only your own entries.
- Workout records and feedback (exercises, duration, sets, weights, effort, discomfort feedback, the maximum heart rate you set) and heart-rate summaries of workouts recorded with our watch app: to log workouts and adjust recommendations.
- Information derived from the above (exercise and content recommendations): to recommend exercises in the app.
- Steps, active energy, sleep and heart rate from Apple Health or Health Connect, if you connect them: to show them to you in the app, as you asked. This is processed on your device and not sent to our servers.
- Photos and results of a body scan you take before creating an account: to show you the result on your device, as you asked. They stay on your device and are sent to our servers only if you create an account.
We collect consumer health data on our servers only with your consent, which you give separately at sign-up. On your device, the app processes a scan you take before sign-up, and data it reads from Apple Health or Health Connect, only because this is necessary to give you the result or display you asked for. We use consumer health data only to provide the features you request. We do not use it for advertising and do not sell it.
2. Sources
You (photos, entries, feedback), your devices (on-phone analysis, our watch app, and Apple Health or Health Connect if you connect them), and the calculations of our app and server.
3. Categories of consumer health data we share, and with whom
We do not share consumer health data with third parties and do not sell it. Our processors handle it only on our instructions, under contracts with us: Amazon Web Services stores it for us in Seoul, Republic of Korea, and sends our service emails; RevenueCat (subscriptions), Expo (app updates and notification delivery), and Apple and Google (notification delivery) receive identifiers such as your account number, device or push token and IP address, together with the fact that you use Bodycheck Care and, for RevenueCat, whether you have Premium, but no scan results, measurements or health values. If you use our Wear OS watch app, Google Play services carry the workout record between your watch and phone, relayed by Google with end-to-end encryption when they are not connected by Bluetooth. We would disclose consumer health data to a court or government authority only if a court order, subpoena or warrant legally compels us to, and only what it requires.
4. Collection by third parties over time and across services
No third party collects consumer health data about your activities over time and across different apps or websites through our app or our Bodycheck Care web pages (every page under www.axonmed.io/axon-care/). The app and those pages contain no third-party advertising, analytics or tracking tools.
5. Your rights and how to use them
You can ask us to confirm whether we collect, share or sell your consumer health data; get a list of the third parties with whom we have shared it and the sources we collected it from (we share it with none); stop collecting or sharing it (withdraw consent); and delete it. To review and change the information in your account, use the app (My account and the record screens) or email us.
Delete your account in the app (My account > Account > Delete account), or email develop@axonmed.io with the subject "Nevada consumer health data request". You do not need an account to make a request. Requests are free. We respond within 20 working days, and in any case within the 45 days the law allows, extendable once by 45 days with notice. If we decline your request, you can appeal by replying with the subject "Consumer health data appeal"; we answer in writing within 45 days. You may also contact the Nevada Office of the Attorney General (ag.nv.gov).
6. Changes to this policy
We will post any material change on this page and tell you in the app and by email at least 30 days before it takes effect. If a change affects how we collect or share consumer health data, we will ask for your consent again before it applies to you.
