This policy describes how AXONMED Co., Ltd. ("AXONMED", "we") handles consumer health data in the Bodycheck Care app (the global version, which is for people aged 18 and over) and its watch apps, as required by the Washington My Health My Data Act (RCW 19.373).
1. Consumer health data we collect, and why and how we use it
| Category | Purpose and how we use it |
|---|---|
| Body scan photos (front and side), copies with the landmarks drawn on them, and the results calculated from them: body landmark positions (including five points on the face, for the nose, eyes and ears), alignment angles, centre-of-gravity values, part scores, body score and grade, findings, body outline | To analyse your posture, show your results and let you compare scans over time |
| Body measurements you enter (height, weight, waist circumference) and body-composition estimates (for example body-fat percentage, lean mass, circumferences) | To estimate your body composition and show your history and trends |
| Health values you enter (blood pressure, blood glucose, HbA1c, weight, body-composition test results from other devices) | To keep your log and show your history; and, for body-composition results you log, to adjust (calibrate) your later photo-based body-composition estimates. This adjustment is done on our server using only your own entries |
| Workout records and feedback (exercises, duration, sets, weights, repetitions, estimated calories, effort, discomfort feedback, the maximum heart rate you set) | To log your workouts and adjust future exercise recommendations |
| Heart-rate summaries of workouts recorded with our watch app (average and maximum heart rate, time in heart-rate zones) | To show the intensity of that workout |
| Information we derive from the above (exercise recommendations, which suggestions are relevant to you) | To recommend exercises and content inside the app |
| Steps, active energy, sleep and heart rate read from Apple Health or Health Connect, if you connect them | To show them to you in the app, as you asked. This is processed on your device and not sent to our servers |
| Photos and results of a body scan you take before creating an account | To show you the result on your device, as you asked. They stay on your device and are sent to our servers only if you create an account; they are then handled as in the first row |
We collect consumer health data on our servers only with your consent, which you give separately at sign-up. On your device, the app processes a scan you take before sign-up, and data it reads from Apple Health or Health Connect, only because this is necessary to give you the result or display you asked for. We use consumer health data only to provide the features you request in the app, to keep it in your account, and to keep the service secure. We do not use it for advertising and do not sell it.
2. Sources of consumer health data
- You: the photos you take, the values you enter and the feedback you give.
- Your devices: the analysis that runs on your phone, our Apple Watch or Wear OS app, and Apple Health or Health Connect if you connect them (read on your device only).
- Our app and our server: scores, estimates, adjustments and recommendations calculated from the information above.
3. Consumer health data we share
We do not share consumer health data with third parties, and we do not sell it.
We disclose it only to processors that handle it on our instructions under contracts with us:
- Amazon Web Services hosts and stores all the consumer health data we keep, in Seoul, Republic of Korea, and sends our service emails (Amazon SES).
- RevenueCat (subscriptions), Expo (app updates and notification delivery), and Apple and Google (notification delivery) receive identifiers such as your account number, device or push token and IP address, together with the fact that you use Bodycheck Care and, for RevenueCat, whether you have Premium. They receive no scan results, measurements or health values. Notifications contain only general reminders such as "Time for a new body scan".
If you use our Wear OS watch app, Google Play services on your watch and phone carry the workout record between them; when they are not connected by Bluetooth, Google relays it over the internet with end-to-end encryption, so Google cannot read it.
We would disclose consumer health data to a court or government authority only if a court order, subpoena or warrant legally compels us to, and only what it requires. We do not disclose it on voluntary request.
4. Third parties and affiliates we share consumer health data with
None. No third party and no affiliate receives consumer health data from us; the processors in section 3 act only on our instructions. The only exception would be a court or government authority that legally compels us to disclose it (section 3).
5. How to exercise your rights
You have the right to:
- confirm whether we collect, share or sell your consumer health data, and access it, including a list of all third parties and affiliates with whom we have shared or sold it and an active email address or other online contact for each;
- withdraw your consent to our collection and sharing of your consumer health data;
- have your consumer health data deleted, including from our processors and from archives and backups.
How to make a request. Delete your account in the app (My account > Account > Delete account), or email develop@axonmed.io with the subject "Consumer health data request". You do not need an account to make a request. We verify requests by confirming control of the email address on the account, or another reasonable way if you cannot use it. Requests are free.
Deleting your account deletes your consumer health data at once. We also delete the emails you sent us within 7 days, except an email we need for an open refund, dispute or legal claim, which we delete when it is closed. Our server security logs, which record your account number and the parts of our service you used but no health values, are kept for up to 1 year. Deleted data is removed from our backups within 6 months.
We respond within 20 working days of receiving your request, and in any case within the 45 days the law allows. If we reasonably need more time, we may extend this once by 45 more days and will tell you why within the first 45 days.
Appeals. If we refuse to act on your request, you can appeal by replying with the subject "Consumer health data appeal". We will answer in writing within 45 days, explain our decision and any action taken, and, if we deny the appeal, tell you how to contact the Washington State Office of the Attorney General to submit a complaint (www.atg.wa.gov/file-complaint).
