These Terms of Use ("Terms") are a contract between you and AXONMED Co., Ltd., a company registered in the Republic of Korea (business registration number 786-81-04109; mail-order sales business report number 2026-Sejong-0575), whose address is Unit 217, 2F, Commercial Bldg., 85 Haemil 3-ro, Sejong-si 30092, Republic of Korea ("AXONMED", "we", "us", "our"). They apply when you use the Bodycheck Care mobile app, its Apple Watch and Wear OS companion apps, and related services (together, the "Service").
These Terms apply to the global version of the Service, which is offered outside the Republic of Korea. If your account was created in the Korean version, the Korean-language Terms of Service apply to you instead.
Our Privacy Policy explains how we handle personal information, including health information. If you live in Washington or Nevada, or your consumer health data is collected there, also see our Consumer Health Data Privacy Policy and Nevada Consumer Health Data Privacy Policy.
Key points
- Bodycheck Care is a wellness and fitness app. It is not a medical device and does not give medical advice.
- You must be 18 or older to create an account.
- Premium renews automatically until you cancel. You cancel in your App Store or Google Play subscription settings, and the app has a "Manage or cancel subscription" button that takes you there. We email you before a free trial ends and before an annual plan renews.
- Deleting your account or the app does not cancel a subscription.
- You keep every right that the consumer law of the place where you live gives you. These Terms contain no arbitration clause and no class-action waiver.
1. Accepting these Terms
You accept these Terms when you tick the Terms of Use box at sign-up and create an account.
You can use parts of the Service before you sign up (for example a trial body scan whose results stay on your device). Before your first trial scan, the app shows a notice with links to these Terms and the Privacy Policy. When you tap "Continue" on that notice, you accept sections 3, 8, 9 and 13 to 20 of these Terms for your use of the Service before sign-up. If you do not agree, do not use the Service.
2. What the Service does
The Service lets you:
- take a front and a side photo with your phone camera and receive a posture analysis (body landmark positions, alignment angles, a body score from 0 to 100, a grade and findings);
- receive an estimate of body composition (such as body-fat percentage, lean mass and body circumferences) calculated on your phone from those photos and the height, weight, age and sex you provide, and, if you log body-composition results from other devices, adjusted on our server using those results;
- get exercise routines selected for your training place, equipment and scan results, with an exercise library and demonstrations;
- log workouts, and keep values you enter yourself, such as weight, blood pressure and blood glucose;
- view steps, active energy, sleep and heart rate from Apple Health or Health Connect on your phone, and use the companion watch app during workouts, if you choose to connect them.
Some features are available only with a paid subscription ("Premium"), as described in section 6.
3. Health and safety
The Service is not a medical device and does not provide medical advice, diagnosis or treatment. It is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition, and it has not been cleared or approved by any medical device regulator (such as the US Food and Drug Administration, Health Canada, Australia's Therapeutic Goods Administration, New Zealand's Medsafe or Singapore's Health Sciences Authority).
- Posture scores, grades, findings, body-composition estimates, reference ranges, exercise suggestions and any other output are general wellness information. They are estimates produced automatically from photos and the information you enter. They can be inaccurate, they depend on photo conditions, clothing and posture, and they can differ from measurements made with medical or body-composition devices.
- Blood pressure, blood glucose and similar values are only what you enter. The Service does not measure them. Any reference range shown next to a value is general information from public guidelines, not an assessment of your health.
- Talk to a qualified healthcare professional before you start a new exercise program, especially if you are pregnant, have a medical condition, an injury or pain, or have been told to limit physical activity. Do not ignore or delay professional medical advice because of something in the Service.
- Stop exercising immediately if you feel pain, dizziness, chest discomfort, shortness of breath or feel unwell, and get medical help if you need it.
- The Service is not for emergencies. In an emergency, call your local emergency number (for example 911 in the United States and Canada, 000 in Australia, 111 in New Zealand, 995 in Singapore, 991 in Brunei Darussalam, 119 in Taiwan and Japan, 811 in Trinidad and Tobago, 911 in Mexico and Panama, or 131 in Chile).
You are responsible for exercising within your limits, in a safe place, with suitable equipment and with appropriate form.
4. Who can use the Service
- You must be at least 18 years old to create an account. We check this with the birth date you enter and, in the United States, with the age information Apple or Google give us where it is available. Please enter your real birth date.
- If you are under the age of majority where you live (for example 19 in some Canadian provinces and US states), you may use the Service only with the permission of a parent or guardian, and you need their permission before buying Premium. Apple and Google may ask a parent or guardian to approve downloads and purchases, and we follow the age and consent information they give us where the law requires it.
- The Service is not directed to children or teenagers. If we learn that someone under 18 has created an account, we will close it, delete their information and refund the unused part of any paid period (section 6.10).
- You may not use the Service if the law where you live does not allow you to.
5. Your account
- You can sign up with an email address and a password you choose (the email address is confirmed with a 6-digit code we send to it), with Sign in with Apple (iOS) or with Google sign-in. Please give accurate information, including your name, birth date and sex, because the Service uses them for its estimates.
- Your account is for you only. Do not sign up using another person's email address or information, and do not share your account.
- Keep your devices and sign-in methods secure. Tell us promptly at develop@axonmed.io if you think someone has used your account without your permission.
- You can delete your account at any time in the app (My account > Account > Delete account) or by following the steps at axonmed.io/axon-care/en/delete-account. Deleting your account deletes your records as described in the Privacy Policy. It does not cancel a Premium subscription (section 6.6).
- If you try a body scan before signing up, the photos and results stay on your device. When you create an account, they move to your account.
- If you do not use your account (open the app while signed in) for 3 years, we will email you, and if you do not use it within 30 days of that email, we will close the account and delete its data as described in the Privacy Policy. If we have no confirmed email address for you, we close it 30 days after the 3 years end. This does not apply while you have an active Premium subscription.
- If you do not use your account for 12 months, we delete your scan photos and body landmark positions, even while you have an active Premium subscription. We email you about 30 days before, if we have a confirmed email address for you. Your other results stay in your account. The Privacy Policy (section 9) explains this.
6. Premium subscription and free trial
6.1 What Premium includes. Premium unlocks the features marked as Premium in the app, currently: every body-part detail with explanations, a full personalized program that updates when you re-scan, comparison with previous scans and trends, and body-composition estimate details and trends. The free features stay free: unlimited body scans, the body score and grade, your top finding, a starter routine, the exercise library, and workout and health logging.
6.2 Who sells it and who bills you. AXONMED sells Premium. Apple (App Store) or Google (Google Play) takes the payment through your Apple Account or Google account, acting for us in the way their terms describe, and their terms and policies also apply to the purchase. We do not receive your payment card details.
6.3 What we show you before you buy. Before you confirm a purchase, the app shows, next to the purchase button: the plan, its price and currency, how often you will be charged, the length of any free trial, the date of your first charge, that the subscription renews automatically until you cancel, how to cancel, our refund policy (section 6.8), that AXONMED is the seller, and links to these Terms and the Privacy Policy. Apple or Google then asks you to confirm the purchase. Prices are set per country and shown with or without taxes as the store displays.
6.4 Free trial. New subscribers may be offered a 7-day free trial. Eligibility is decided by Apple or Google; generally you can have one free trial for Premium per Apple Account or Google account, so switching plans does not give a second trial. You are not charged during the trial. If you do not cancel before the trial ends, your subscription starts and you are charged the price shown when you started the trial, on the date shown. On the App Store, cancel at least 24 hours before the trial ends; on Google Play, cancel before the trial ends. We will email you a reminder at least 3 days and no more than 10 days before your free trial ends, with the end date, the price that will then apply and how to cancel. If we do not send that reminder at least 3 days before your trial ends and you are then charged, tell us within 30 days of the charge and we will refund that first charge in full (section 6.10). If you buy a subscription during a free trial, any unused part of the trial ends when the store says it does.
6.5 Automatic renewal. Your subscription renews automatically at the end of each billing period (each month or each year) for the same period, and you are charged the current price for your plan, until you cancel. On the App Store, cancel at least 24 hours before the end of the current period; Apple charges the renewal within the 24 hours before the period ends. On Google Play, cancel before the renewal date.
6.6 How to cancel. You can cancel at any time, online, without contacting us:
- In the app: My account > Subscription > Manage or cancel subscription. This opens your store's subscription page.
- iPhone or iPad: Settings > your name > Subscriptions > Bodycheck Care Premium > Cancel Subscription, or go to apps.apple.com/account/subscriptions.
- Android: Google Play app > your profile picture > Payments & subscriptions > Subscriptions > Bodycheck Care Premium > Cancel subscription, or go to play.google.com/store/account/subscriptions.
After you cancel, Premium stays active until the end of the period you have already paid for, and you are not charged again. We cannot cancel a store subscription for you, but our support page explains each step: axonmed.io/axon-care/en/support.
6.7 Confirmation and reminders. We send these messages to the email address on your account (if you use Sign in with Apple with a hidden email, Apple forwards them to you). The yearly reminder and the annual-plan renewal reminder also appear in the app's notifications:
- a confirmation right after you start a trial or subscription, with the plan, price, trial end date, renewal terms, how to cancel, our refund policy and our contact details (in Taiwan, also the 7-day cancellation right in section 17.7 and how we handle complaints);
- the free-trial reminder in section 6.4;
- for annual plans, a reminder 30 to 45 days before each renewal, with the renewal date, the price and how to cancel;
- for monthly plans, a reminder at least once a year with the price and how to cancel;
- notice of a price increase as described in section 6.9.
6.8 Refunds. Payments are generally non-refundable, and we do not refund partly used billing periods, except where these Terms or the law where you live say otherwise (sections 6.4 and 6.10, and section 17 for some country-specific rights). Apple and Google handle refund requests for purchases made through them:
- App Store: request a refund at reportaproblem.apple.com.
- Google Play: request a refund through your Google Play order history, or contact us and we will review the request.
If Premium does not work as described, contact us at develop@axonmed.io and we will help, including with a refund request.
6.9 Price changes. If we increase the price of your plan, we will tell you by email and in the app at least 14 and no more than 30 days before the new price applies to you, counting by the date where you live. In Canada the notice period is 30 to 60 days instead (section 17.2). Apple or Google will also notify you and, where their rules require, ask for your agreement before charging the new price. If you do not want to pay the new price, cancel before it applies. A price increase never applies to a period you have already paid for.
6.10 Changes to Premium and refunds of unused periods. We may add or improve Premium features. If we plan to remove a main Premium feature, we will tell you at least 30 days in advance. We refund the unused part of a period you have already paid for if:
- we remove a main Premium feature during that period and you cancel;
- we stop providing the Service or Premium (section 11);
- we close your account without a breach by you, including because you are under the minimum age (sections 4 and 12);
- you withdraw your consent to our use of your health information, including by deleting your account (Privacy Policy, section 4). Please also cancel the subscription in your store (section 6.6); if it renews before you do, we refund that renewal too.
We also refund a first charge as section 6.4 describes. To ask for any of these refunds, email develop@axonmed.io with the subject "Refund". We refund Google Play purchases through Google Play where it allows; otherwise (including all App Store purchases, which we cannot refund through Apple) we pay the refund directly to you, as explained on our support page.
6.11 Restoring purchases. Premium is tied to your Bodycheck Care account. If you change devices or reinstall the app, sign in and use "Restore purchases". Family Sharing is not available for Premium.
6.12 Korea. The Korean version of the Service is free and does not offer Premium.
7. Your content
- "Your Content" means the photos you take in the Service, the values and notes you enter, and your workout records. You keep all rights in Your Content.
- You give us a worldwide, non-exclusive, royalty-free permission to host, store, copy, process and display Your Content only as needed to provide the Service to you (for example to run the analyses you ask for and show your history). This permission ends when Your Content is deleted, except for copies we must keep by law.
- Only take and upload photos of yourself. Do not upload photos of anyone else.
- If you save or share a result image outside the app, you control that copy.
8. Our content and your licence to use the app
- The app, its software, design, analysis methods, exercise names, descriptions and demonstrations belong to us or to our licensors. You may use them only inside the Service for your personal, non-commercial use.
- Subject to these Terms, we give you a personal, revocable, non-exclusive, non-transferable licence to install and use the app on devices you own or control, as permitted by the App Store or Google Play usage rules.
9. Acceptable use
You agree not to:
- use the Service in breach of the law or anyone's rights;
- sign up or act as another person, or submit another person's photos or information;
- copy, scrape or extract content, data or models from the Service, or reverse engineer or decompile the app, except where the law allows this despite this restriction;
- interfere with the Service, its security or other users, or access it with bots or other automated means;
- use the Service or its output to provide medical or professional services, or to make decisions about other people.
Nothing in these Terms limits your right to post honest reviews, ratings or comments about the Service, wherever you live.
10. Third-party services
The Service works with services we do not control, including Apple (App Store, Sign in with Apple, Apple Health, Apple Watch) and Google (Google Play, Google sign-in, Health Connect, Wear OS). Their own terms and privacy policies apply to your use of them. Connecting Apple Health or Health Connect is optional, and you can turn it off at any time in your device settings.
11. Changes to the Service and ending the Service
- We may add, change or remove features, and we may pause the Service for maintenance, security or reasons beyond our control. We will try to give notice of planned interruptions in the app.
- If we decide to stop providing the Service or Premium, we will give you at least 30 days' notice in the app and by email, let you download or delete your records during that time, stop renewals, and refund the unused part of any period you have already paid for (in the way described in section 6.10).
12. Suspension and termination
- You may stop using the Service and delete your account at any time.
- We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the Service. Except where the law or a security risk prevents it, we will tell you the reason first and give you a reasonable chance to fix the problem. If we close your account without a breach by you, we will refund the unused part of any Premium period you have already paid for (in the way described in section 6.10).
- Sections 3, 6.8 to 6.10 (refunds), 7 (ending of our permission), 8, the refund promises in sections 11 and 12, and sections 13, 14, 16, 17, 18, 20 and 21 continue after these Terms end.
13. Disclaimers
The following paragraph does not apply to consumers in Québec.
We provide the Service with reasonable care and skill. Apart from that, and apart from any guarantee or warranty that the law of the place where you live does not allow us to exclude, we provide the Service "as is" and "as available". We do not promise that scores or estimates will be accurate for you, that the Service will meet a particular purpose of yours, or that it will always be available or free of errors. This section does not limit any consumer guarantee, warranty or remedy that cannot be excluded under the law of the place where you live; section 17 explains these for some countries and states.
14. Limitation of liability
The following paragraphs do not apply to consumers in Québec.
To the extent the law of the place where you live allows:
- we are not liable for losses that were not reasonably foreseeable when you accepted these Terms, or for loss of data you could have avoided by following our instructions, or for business losses (the Service is for personal use only); and
- our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid for Premium in the 12 months before the event giving rise to the claim and (b) USD 50.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, for breach of a consumer guarantee or statutory right that cannot be limited, or for any other liability that the law of the place where you live does not allow us to limit.
15. Changes to these Terms
We may update these Terms, for example to reflect new features, new laws or a change in how Premium is sold. For any change that is not purely in your favour, we will tell you in the app and by email at least 30 days before it takes effect, show you the new wording and the wording it replaces, and give the date it takes effect. If you do not agree, you can cancel your subscription and delete your account before the change takes effect, without any cost, and section 6.10 applies to any period you have already paid for. We will not change the price, billing period or main features of a Premium period you have already paid for. Changes required urgently by law or to fix a security problem may take effect sooner; we will tell you as soon as we can.
16. Governing law and disputes
The following paragraph does not apply to consumers in Québec (see section 17.2).
If you use the Service as a consumer, these Terms are governed by the laws of the country where you habitually live (and of your state, province or territory where that applies). Otherwise, they are governed by the laws of the Republic of Korea. You may bring a claim about these Terms or the Service in the courts of the place where you live or in the courts of the Republic of Korea. If we need to bring a claim against you, we will do so only in the courts of the place where you live.
Nothing in these Terms requires you to use arbitration or waives your right to bring or join a class or representative action, to use a small-claims court, or to complain to a consumer protection authority. We would like the chance to fix a problem first, so please contact us at develop@axonmed.io before starting a formal claim; this is a request, not a condition.
17. Country- and state-specific terms
If anything in this section conflicts with the rest of these Terms, this section applies to you.
17.1 United States
- No arbitration. Disputes are resolved in court as described in section 16.
- California. Under California Civil Code section 1789.3, California users are entitled to the following notice: the Service is provided by AXONMED Co., Ltd., whose contact details are in section 21. The charges for Premium are shown in the app before purchase. You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
- New Jersey. If you live in New Jersey, the exclusions in section 13 and section 14 do not apply to you, and all other sections of these Terms apply.
17.2 Canada and Québec
- Your copy of the contract. The confirmation email in section 6.7 is your copy of the contract. We send it within 15 days of your purchase (in practice, right away), with the information the consumer protection law of your province requires.
- French version for Québec. If you live in Québec, these Terms are provided to you in French at www.axonmed.io/axon-care/fr/terms/. The French version is the version that binds you and us, and if the French and English versions differ, the French version applies to you.
- Québec law and courts. If you live in Québec, these Terms are governed by the laws of Québec and the federal laws of Canada that apply there, and the courts of Québec have jurisdiction. Sections 13 and 14 and the first paragraph of section 16 do not apply to you. The Québec Consumer Protection Act applies to you, including its rules on contracts made at a distance and on contracts involving sequential performance, and its cancellation rights.
- Changes in Canada. If you live in Canada (including Québec and British Columbia), we may change only the following elements of these Terms: the description of features (other than the main Premium features of a period you have already paid for), prices for future billing periods, practical procedures such as how to contact us, and wording needed to comply with the law. We will send you a written notice at least 30 and no more than 60 days before the change takes effect, setting out the new clause, the clause as it read before and the date the change takes effect. If the change increases your obligations or reduces ours, you may refuse it and cancel your subscription without cost or penalty by telling us within 30 days after the change takes effect.
- Other provinces. Nothing in these Terms limits any right or remedy you have under the consumer protection law of your province, including rights to receive a copy of your contract and to cancel.
- British Columbia annual plans. If an annual plan is offered to you and you live in British Columbia, you may cancel at any time and receive a refund of the unused part of the year within 15 days, as provided by the Business Practices and Consumer Protection Act.
17.3 Australia
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. Sections 13 and 14 apply only to the extent they are consistent with it.
17.4 New Zealand
If you use the Service as a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply, and nothing in these Terms limits your rights under them. Sections 13 and 14 apply only to the extent those Acts allow.
17.5 Singapore
Nothing in these Terms excludes or limits any right you have under the Consumer Protection (Fair Trading) Act 2003, or any liability that cannot be excluded or limited under the Unfair Contract Terms Act 1977 or other Singapore law.
17.6 Brunei Darussalam
Nothing in these Terms excludes or limits any right you have under the Consumer Protection (Fair Trading) Act (Chapter 261, formerly the Consumer Protection (Fair Trading) Order, 2011), or any liability that cannot be excluded or limited under the laws of Brunei Darussalam. Sections 13 and 14 apply only to the extent those laws allow.
17.7 Taiwan
- 7-day cancellation. If you are a consumer in Taiwan, you may cancel your Premium subscription without giving a reason and without any cost within 7 days after the paid subscription starts or, if you began with a free trial, within 7 days after your first paid charge. Email develop@axonmed.io with the subject "Refund" (an email counts as written notice). We will refund that charge in full within 15 days after we receive your email (section 6.10 explains how we pay refunds), and your Premium access then ends. Please also cancel automatic renewal in your store (section 6.6); if a renewal happens before you do, we refund it too. This is your right under Articles 19 and 19-2 of the Consumer Protection Act.
- Your rights. Nothing in these Terms waives or limits your rights under the Consumer Protection Act or the Personal Data Protection Act, and any term that is invalid under them does not apply to you. Sections 13 and 14 apply only as far as Taiwan law allows.
- Complaints. Contact us first at develop@axonmed.io; we reply within 15 days. You may also complain to your local government's consumer protection officer or the Executive Yuan's Consumer Protection Committee, or apply for mediation.
17.8 Trinidad and Tobago
If you use the Service as a consumer in Trinidad and Tobago, nothing in these Terms excludes or limits any right or remedy you have under the laws of Trinidad and Tobago that cannot be excluded or limited, including the Unfair Contract Terms Act, the Consumer Protection and Safety Act and, where it applies, the Electronic Transactions Act, 2011. Sections 13 and 14 apply only to the extent those laws allow.
17.9 Japan
- Your rights. If you are a consumer in Japan, nothing in these Terms limits your rights under the Consumer Contract Act or any other Japanese law that cannot be excluded, and any term that is void under the Consumer Contract Act does not apply to you. 18. App Store terms (Apple)
If you downloaded the app from Apple's App Store, the following also applies:
- These Terms are between you and AXONMED only, not Apple. AXONMED, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing where available.
- AXONMED, not Apple, is responsible for maintenance and support of the app (section 21). Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app; any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are AXONMED's responsibility, subject to these Terms.
- AXONMED, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with HealthKit.
- If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, AXONMED, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use the app (for example your mobile data service agreement).
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
19. Google Play
If you downloaded the app from Google Play, Google Play's terms of service and policies also apply to your use of Google Play and to purchases made through it. Google is not a party to these Terms and is not responsible for the app.
20. General
- If a court finds part of these Terms unenforceable, the rest stays in effect.
- If we do not enforce a provision straight away, we can still enforce it later.
- You may not transfer your rights under these Terms to anyone else. We may transfer our rights and obligations to another company as part of a merger, acquisition or sale of assets, if your rights under these Terms are not reduced, and we will tell you if that happens.
- These Terms are the whole agreement between you and us about the Service. They do not include the Privacy Policy, which is a notice about how we handle personal information.
- The app is available in English, French, Spanish, Japanese and Traditional Chinese. These Terms are written in English and are also published in French and Spanish.
